Online gambling legislation

The online gambling industry is exploding in the United States and the New Jersey online casino market is currently one of the most prosperous places to be.

When the Unlawful Internet Gambling Enforcement Act (UIGEA) of 2006 passed through US legislation, it clarified the fact that online gambling law in the US is defined through the state’s rights. The UIGEA specifically “prohibits gambling businesses from knowingly accepting payments in connection with the participation of another person in a bet or wager that involves the use of the internet and that is unlawful under any federal or state law.” The passing of this law chased most poker and casino sites out of the US, however, it did provide clarity. The UIGEA exempts intrastate gambling that is allowed under state legislation. It requires these states who move forward with online gambling regulation to enforce age restrictions and location verification services. This law permitted basically any form of gambling outside of sports betting under state legislation.

In 2011, there was a re-evaluation of the Federal Wire Act of 1961. The Federal Wire Act of 1961 was put in place to restrict betting companies' information from being transmitted through wire communications across state lines. This law was originally enforced to help end organized crime through interstate gambling. This was of course before the internet existed. Now that the internet affects business and everyday life, the people decided it was time for a re-evaluation. The new opinion on the Federal Wire Act stated that it shall only apply to sports betting.

The New Jersey Legislature legalized online gambling within its borders through the passage of bill A2578 in February of 2013. 

Then came the Supreme Court’s decision to overturn the Professional and Amateur Sports Protection Act (PASPA) in 2018, allowing for states to regulate sports betting within their state borders. When the Supreme Court overturned this bill, they declared that the bill had been unconstitutional. Despite the fact that PASPA limited sports betting, the American Gaming Association (AGA) found that over $150 billion was being gambled on sports each year in the United States - 97% through illegal wagering.

Now, in the state of New Jersey, one can participate in online casino gambling and sports betting, both in physical locations as well as online.
